ARTICLE 1 - Organizing company
La société LEADER HOTELS sous le label commercial DES HOTELS ET DES ILES au capital de 7622.45 euros immatriculée au RCS Paris B339 261 695 ayant son siège social a P/O CREOLE BEACH – BP 61 / 97190 Gosier – Guadeloupe (ci-après la « Société Organisatrice »), organise du 15 juin 2025 au 29 juin 2025 à 23h59 inclus, heure de la France métropolitaine, un jeu gratuit de type tirage au sort et sans obligation d’achat intitulé « Jeu concours créateurs de contenus– @voyageursfrancais, @adelestravel & @poussine 2025 », sur les pages Instagram: @voyageursfrancais, @adelestravel, @poussine,@latoubanahotelandspa & @lejardinmalanga, dans les conditions définies ci-après (ci-après le « Jeu »).
ARTICLE 2 - Participants
This Game is open to all individuals of legal age (as evidenced by their marital status) and capacity.
Any participation in this Game implies unreserved acceptance by the participants (hereinafter the "Participants") of these Rules (hereinafter the "Rules"), without any reservation or prior condition on the part of the candidate (failure to comply with the Rules will result in the pure and simple nullity of the candidate's participation and the awarding of any prizes).
Toute participation au Jeu incomplète, non-conforme aux conditions exposées dans le Règlement, comportant des indications fausses, falsifiées, erronées ou enregistrées après la date limite de participation (29 juin 2025, 23h59 inclus, heure de la France métropolitaine faisant foi) ne sera pas prise en compte et sera considérée comme nulle.

À compter du 15 juin et jusqu’au 29 juin 2025, à 23h59 inclus, heure de la France métropolitaine faisant foi, dans le cadre duquel 1 (un) séjour tel que décrit à l’article 4 ci-après, pourra être remporté.

ARTICLE 4 - Winning entries and prizes
4.1 Designation of the winner
Le Jeu concours fera l’objet d’un tirage au sort parmi toutes les participations valides au jeu enregistrées depuis le 15 juin 2025 et répondant aux conditions énoncées dans l’article 3 du présent Règlement. Le tirage au sort désignera celui ou celle qui remportera le lot suivant : 1 séjour de 5 nuits en hébergement et petit-déjeuner pour2 personnes : 3 nuits à La Toubana Hôtel & Spa + 2 nuits au Jardin Malanga.
Ce concours est organisé gratuitement pour la communauté des influenceurs. Aucun des créateurs n’est rémunéré ou gratifié en échange de sa participation. Le lot est exclusivement destiné au gagnant tiré au sort parmi les participants. Aucun hébergement, prestation ou contrepartie n’est attribué(e) aux créateurs, maintenant ou ultérieurement. In this respect, the participant designated as the winner certifies that the personal data he/she may be asked to provide are real and true. He/she also agrees to submit to any verification of the veracity of the contact details provided (telephone number, name, address, contact details, etc.), the definitive awarding of the prize being pronounced after said verifications.
The participant authorizes all verifications concerning his/her identity and domicile. To this end, the Organizing Company reserves the right to request any participant to provide a copy of documents attesting to these elements. Any false or erroneous declaration, in particular concerning contact details, will automatically result in the cancellation of the prize.
In addition, the Organizing Body reserves the right to cancel the entries of anyone who is registered several times under different identities or who provides inaccurate or manifestly inconsistent and/or fanciful information, and generally in the event of fraud.
Par l’acceptation de son lot, le gagnant autorise expressément et gratuitement la Société Organisatrice à faire figurer son nom et prénom sur tous supports, notamment commerciaux, à des fins d’information, de crédit photo (sauf opposition expresse) ou de promotion pour toute exploitation liée au Jeu jusqu’au 02 juillet 2025, 23h59. Cette autorisation n’ouvre droit, dans les conditions susvisées, à aucun droit ni contrepartie financière au profit du gagnant, autre que la remise de la dotation. Il est ici précisé que le gagnant pourra retirer son autorisation dans les conditions définies à l’article 5.
4.2 Endowments
Étant précisé que la valorisation moyenne de l’opération est de 2818€ TTC, il est ici précisé que :
• Il y aura un seul gagnant,
• Le lot ne donnera pas lieu à une équivalence monétaire ou à un échange pour quelque cause que ce soit,
• Le lot émis sera non cessible, non échangeable et non remboursable,
• Lot non utilisable pendant les vacances scolaires métropolitaines (sauf été),
• Sous réserve de disponibilité, hors transport aérien, transferts aéroport/hôtel/aéroport,
• Tout lot non utilisé dans l’année suivant sa remise sera définitivement perdu,
• En cas de force majeure ou toute autre circonstance indépendante de la volonté de la Société Organisatrice, cette dernière se réserve le droit de remplacer la dotation prévue par une autre de nature et de valeur équivalente à la précédente.
4.3 Terms of delivery
The Game winner will be notified of the result by private message sent from the Instagram messaging service within one (1) day of the draw.
The Organizing Body may not be held liable for sending an e-mail to an incorrect address due to an error on the part of the participant, nor for the malfunction of the e-mail sending system. Nor can the Organizing Body be held liable for any change in the winner's e-mail address.
If the winner does not contact the Organizing Body in writing (e-mail, letter, etc.) within seven (7) days of the date on which he/she was first notified, the prize will be definitively forfeited.
Once the winner has accepted the prize, he/she will receive an e-mail confirming his/her win, with details of how to reserve/hand over the prize.
ARTICLE 5 - Personal data
In the context of the Game, the Organizing Body may collect participants' personal data.
In accordance with the provisions of article 34 of law no. 78-17 known as the "Loi Informatique et Libertés", all participants are informed that the personal information collected is necessary for their participation in this Game and is subject to computer processing. In this respect, the Organizing Company guarantees that the personal data collected will be processed in compliance with the applicable legislation, including the French Data Protection Act (Loi Informatique et Libertés) and European Regulation 2016/679 of April 27, 2016 on the protection of personal data (hereinafter the "RGPD").
The data collected may be communicated to service providers and subcontractors that the Organizing Body may call upon for the purposes of organizing and/or managing the Game. In this respect, the Organizing Body guarantees that the data collected by these service providers and subcontractors will be processed in compliance with the RGPD.
The participant is informed that he/she has the right to access, rectify, oppose or delete his/her personal data. These rights may be exercised by writing to Des Hôtels & Des Îles at the following address:

Participants who exercise their right to delete their personal data before the end of the Game will be deemed to have waived their right to participate.
Depending on the choices made by participants at the time of data collection, the data may also be used to inform participants of Des Hôtels & Des Îles news and commercial offers, it being specified here that winners may withdraw their authorization at any time by sending a letter to the Marketing Department whose contact details are given above.

ARTICLE 6 - Liability
The Organizing Body may cancel or suspend all or part of the Game if it appears that fraud has occurred in any form whatsoever in connection with participation in the Game. In the event of misconduct or fraud on the part of a participant, the Organizing Body reserves the right to automatically disqualify any participation by the latter and/or the right not to award the prize to the fraudsters and/or to prosecute the perpetrators of such fraud before the competent courts, without the latter being able to claim anything whatsoever.
However, the Organizing Body may not be held liable in any way whatsoever to participants if it is forced to shorten, extend or cancel the present Contest, or to modify its conditions for any reason whatsoever. In particular, it will be considered fraudulent for a participant to register and then take part in the Game under one or more fictitious names or names borrowed from one or more third parties. Each participant must register and take part in the Game under his or her own and unique name.
The connection of any person to the Internet sites from which participation is made and participation in the Game is under the sole responsibility of the participants. It is the responsibility of each participant to take all appropriate measures to protect their own data and/or software stored on the computer used to take part in the Game against any attack.
The Organizing Body and its subcontractors decline all responsibility for any incidents that may occur during the enjoyment of the prize and/or due to its use and/or its consequences.
ARTICLE 7 - Acceptance and availability of the Rules
La participation au Jeu implique l’acceptation pleine et entière du Règlement, disponible sur le site Internet de Des Hôtels & Des Iles.
To be taken into account, any disputes relating to the Rules must be made in writing and addressed to the Marketing Department of the Organizing Body, whose contact details are given in Article 5, no later than thirty (30) days after the closing date for participation in the Game as indicated in Article 3 of the Rules.
The complete Rules will be sent free of charge to anyone who requests them in writing to Des Hôtels & Des Îles 120 Rue La Boétie 75008 Paris.
ARTICLE 8 - Modification of the Rules
The Organizing Body reserves the right to modify the Rules. In this case, the modifications made will be inserted in the Rules. These modifications will form an integral part of the Rules and will be considered as annexes thereto.
ARTICLE 9 - Applicable law - Jurisdiction
The Regulations are governed by French law.
Any difficulty relating to the application, interpretation or consequences of the Regulations will be settled by the competent court.
